Welcome to the Xoon App (hereinafter referred to as "the App"). Before you start using the App, please carefully read the following User Agreement (hereinafter referred to as "the Agreement"). By using the App, you indicate that you have read, understood, and agree to be bound by the Agreement. If you do not agree with any part of the Agreement, please stop using the App immediately.
Definitions
1.1 "User" refers to any individual or entity using the App.
User Responsibilities
2.1 Users are responsible for all actions taken while using the App and agree to comply with applicable laws and regulations.
2.2 Users must not engage in the following activities while using the App:
a. Publish, disseminate, or otherwise provide any content that is illegal, harmful, malicious, infringes on others' rights, or damages others' interests;
b. Infringe on any third party's intellectual property rights or other legal rights;
c. Collect, store, or use other users' personal information without authorization;
d. Disrupt or interfere with the normal operation of the App;
e. Violate any provision of this Agreement.
2.3 Users should properly safeguard their account and password and are fully responsible for all activities conducted using their account and password.
Privacy Policy
3.1 The App will protect users' personal information in accordance with applicable privacy laws and this Privacy Policy.
3.2 While users are using the App, their personal information may be collected and used. The collection and use of personal information will follow the provisions of this Privacy Policy.
3.3 Users agree to the App's collection, storage, use, and disclosure of their personal information as described. Specific collection and use provisions will be clearly communicated to users on relevant pages or features.
3.4 We are committed to taking reasonable security measures to protect users' personal information from unauthorized access, use, or disclosure.
3.5 Users understand and agree that we may disclose their personal information if required by law or to protect our legal rights.
Disclaimer
4.1 Users understand and agree that using the App is at their own risk. All content provided by the App is for reference only and does not constitute any form of warranty or commitment.
4.2 We are not liable for any direct or indirect losses arising from the use of the App.
Changes and Termination of the Agreement
5.1 We reserve the right to modify the content of this Agreement at any time. The modified Agreement will be published on the App. Continued use of the App signifies agreement to the modified Agreement.
5.2 We reserve the right to terminate the provision of the App to users at any time and to delete users' accounts or any related information.
Governing Law and Dispute Resolution
6.1 The interpretation, application, and dispute resolution of this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China.
6.2 Any disputes or conflicts arising from this Agreement should be resolved through amicable negotiations. If negotiations fail, either party has the right to submit the dispute to a court with jurisdiction for resolution.
Virtual Items
7.1 You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to purchase virtual gems (“Gems”) and virtual gifts (“Gifts”) and to give Gifts to others.
7.2 The price of Gems will be displayed at the time of purchase. All fees and payments for Gems will be processed through the relevant payment mechanism in the currency specified at the time of purchase. Currency conversion settlements, cross-border transaction fees, and payment channel fees (if applicable) will be based on your agreement with the applicable payment provider.
7.3 You are responsible for paying the fees for any Gems you purchase. Upon completion of the purchase, your user account will be credited with the corresponding number of Gems. Gems can be used to purchase Gifts. Gems cannot be redeemed for cash, legal tender, the currency of any country, region, or political entity, or any other form of credit. Gems can only be used on XOON LIVE as part of our services and cannot be combined with other promotions, coupons, discounts, or special offers unless otherwise specified by us.
7.4 Unless otherwise specified in this Agreement, all sales of Gems and gifts are final, and we do not provide refunds for any purchased Gems or gifts. Gems and gifts cannot be redeemed or exchanged for cash under any circumstances, nor can they be refunded or reimbursed by us. Additionally, when you log in as a user, you agree that we may collect and share your information when you make an in-app purchase on Apple. This is to facilitate appropriate decisions by the app store in the event of payment issues or chargebacks.
